Agreement

You represent that you are at least 18 years old and have legal capacity to contract, or that you use the Site under the supervision of a parent or legal guardian who accepts these Terms on your behalf. We may update these Terms from time to time; the “Last updated” date below will change when we do. Where changes are material, we will provide reasonable notice on the Site or by email where we hold your address. Continued use after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.

Acceptable use

You agree to use the Site only for lawful purposes. Without limitation, you must not:

  • attempt to gain unauthorised access to our systems, other users’ accounts, or data;
  • introduce malware, overload infrastructure, or interfere with security or integrity;
  • scrape, harvest, or automate access to the Site at a scale that impairs performance without our prior written consent;
  • misrepresent your identity, manipulate reviews, or post unlawful, defamatory, or infringing content;
  • use the Site to transmit spam or unsolicited commercial messages.

We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to other users. We may investigate suspected violations and cooperate with law enforcement where required.

Accounts

If you create an account, you are responsible for safeguarding your login credentials and for all activity under your account. You must provide accurate, current information and promptly update it when it changes. Notify us immediately if you suspect unauthorised use.

Content and intellectual property

Unless otherwise indicated, text, graphics, logos, itineraries, layouts, and software on the Site are owned by or licensed to The Weekend Dash and are protected by copyright, trade mark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and display the Site for personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Site without our prior written consent, except for temporary copies made by your browser or as allowed by fair dealing under Australian law.

Itineraries, indicative prices, and availability are provided for planning purposes and may change without notice. Always confirm critical details with operators before you travel.

Bookings and third parties

Many experiences are delivered by independent suppliers. Their conditions (for example, age limits, fitness requirements, cancellation fees) may apply in addition to these Terms. To the extent permitted by law, we are not responsible for acts or omissions of third-party suppliers, except where we have failed to meet our obligations under the Australian Consumer Law or these Terms.

You are responsible for obtaining valid travel documents, insurance, permits, and health advice for your itinerary. You must follow safety instructions provided by guides and venue staff.

Disclaimers and liability

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except those that cannot be excluded under the Australian Consumer Law.

Subject to the ACL and other non-excludable rights, our total aggregate liability arising from or in connection with the Site or these Terms is limited to the greater of AUD $100 or the amounts you paid to us for the specific booking or product giving rise to the claim in the twelve months before the event. We are not liable for indirect, consequential, or punitive damages, or for loss of profits, data, or goodwill, except where such exclusion is prohibited by law.

Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales shall have non-exclusive jurisdiction, subject to any mandatory rights you have to bring proceedings in your home jurisdiction under consumer protection laws.

Before commencing formal proceedings, you agree to contact us in good faith to attempt to resolve the dispute through our Contact channels.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless The Weekend Dash and its officers, employees, and contractors from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any third-party rights.
